This website, thrivecreative.us, is operated by KARLA THE LOSEN LLC, a limited liability company registered in OHIO, trading as Thrive Creative, of 7 Dutch Street, #4, NY, ,NY 10038 United States ("we," "us," "our"). By browsing this site or placing an order you agree to these Terms of Service, together with our Shipping Policy, Refund and Return Policy, and Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use this site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm you meet that requirement and that the payment method you use is yours or that you are authorised to use it.

Our products

Our products are printed to order. Designs are drawn from Italian marbled papers and are reproduced by printing; they are not physical marbled paper and they are not stone marble. Each product page states the materials used.

Because marbled artwork is irregular by nature and because printing is applied to a curved surface, pattern placement, colour, and texture vary slightly between individual items. This variation is a characteristic of the product, not a defect, and is not grounds for return under Section 4 of the Refund and Return Policy.

Colours shown on screen depend on your display and will not match the finished item exactly.

Cases are made to fit the specific device model you select at checkout. Selecting the correct model is your responsibility. If you are unsure, check Settings › General › About on your device before ordering.

Protective claims

Terms such as "impact resistant," "tough," and "dual layer" describe construction and materials. They are not a warranty that your device will not be damaged. We do not insure your device and are not liable for damage to any device used with our products. See the Limited Warranty in our Refund and Return Policy.

Pricing, currency, and errors

Prices are shown in the currency selected in our region selector and are exclusive of shipping, taxes, and any import duties. Prices may change at any time before you place an order.

Despite our efforts, a product may occasionally be listed at an incorrect price or with an incorrect description. Where a pricing or description error is obvious and could reasonably have been recognised by you as an error, we may cancel the order and refund you in full, whether or not the order has been confirmed. We will notify you before doing so.

Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt; it is not acceptance. The contract is formed when we confirm that your order has been dispatched. We may refuse or limit any order, including where we suspect fraud, where a product is unavailable, or where an order appears placed for resale.

Availability

Product availability shown on the site is indicative. Where a device model is listed that is not yet released or not available from our production partner, the product page will say so. If we cannot fulfil an order we will cancel it and refund you in full.

Payment and taxes

Payment is taken at checkout through our payment processor. Sales tax is applied where we are required to collect it. For international orders, import duties and taxes are your responsibility as set out in the Shipping Policy.

Intellectual property

All content on this site, including artwork, product designs, photographs, text, the Thrive Creative name and logo, and the arrangement of the site, is owned by us or used by us under licence or in public domain, and is protected by copyright and trademark law.

You may not reproduce, distribute, or create derivative works from any content on this site, or use our designs on your own products, without our prior written permission. Purchase of a product grants you ownership of that physical item only and no rights in the design applied to it.

Third-party trademarks

Apple, iPhone, iPad, AirPods, AirPods Max, MagSafe, and related marks are trademarks of Apple Inc. Samsung and Galaxy are trademarks of Samsung Electronics Co., Ltd. Any other third-party marks belong to their respective owners.

KARLA THE LOSEN LLC is not affiliated with, endorsed by, sponsored by, or authorised by Apple Inc., Samsung, or any other device manufacturer. Device names are used solely to identify compatibility. Products described as MagSafe compatible contain an embedded magnet array; compatibility with non-Apple chargers is not guaranteed.

Reviews, submissions, and user content

If you submit a review, photograph, comment, or other material to us or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that material in connection with our business, and you confirm the material is yours to give and does not infringe anyone's rights. We do not pay for reviews and do not condition any benefit on the review being positive. We may remove any submission at our discretion.

Acceptable use

You may not use this site to break the law, to infringe anyone's rights, to transmit malicious code, to scrape or harvest data, or to interfere with the site's operation or security.

Third-party links

Our site links to third-party services including our wholesale storefront and our social media accounts. We do not control those sites and are not responsible for their content, products, or policies.

Disclaimer

Except for the Limited Warranty in our Refund and Return Policy, and to the fullest extent permitted by law, this site and our products are provided on an "as is" and "as available" basis, and we disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for the products in that order. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, data, or device value.

Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for any liability that cannot lawfully be excluded. Nothing in these Terms limits any statutory right you have as a consumer.

Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the site.

Governing law and disputes

These Terms are governed by the laws of the State of  NEW YORK, United States, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts sitting in NEW YORK, NY, and you and we consent to that jurisdiction.

If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.

Before you sue us

If you have a dispute, contact us first at hello@thrivecreative.us with a description of the issue and the outcome you want. We will respond within 30 days. Either of us may still bring an individual claim in small claims court.

Force majeure

We are not liable for delay or failure caused by events outside our reasonable control, including carrier disruption, production partner failure, natural events, or acts of government.

Changes to these Terms

We may update these Terms. The version posted at the time you place an order governs that order. The last updated date appears below.

General

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a sale or reorganisation of the business. These Terms, with the policies incorporated into them, are the entire agreement between us.
